Examinity terms & conditions

Welcome to Examinity, operated by Examinity Learning Private Limited ("Company", "Examinity", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of the Examinity website, mobile applications, digital products, online services, subscriptions, publications, mock tests, educational resources, and all related services (collectively, the "Platform"). By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, you must not access or use the Platform.

Definitions

For the purposes of these Terms:

  • Platform means the Examinity website, mobile applications, software, products, services, digital content, and all related offerings provided by Examinity.
  • User means any individual or entity accessing or using the Platform.
  • Content includes, without limitation, books, eBooks, notes, mock tests, question banks, videos, graphics, software, digital content, publications, research materials, trademarks, logos, databases, and all other materials made available through the Platform.
  • Services means all educational, publishing, assessment, subscription, mentoring, career development, and related services offered by Examinity.

Eligibility

You must be legally capable of entering into a binding agreement under the applicable laws of India.

If you are below the age required to enter into a legally binding agreement under applicable law, you may access or use the Platform only under the supervision of, and with the consent of, your parent or legal guardian, who agrees to be bound by these Terms on your behalf.

User Account

Certain features and services of the Platform may require you to create and maintain a user account.

By creating an account, you agree to:

  • Provide accurate, complete, and up-to-date information during registration and keep such information updated at all times.
  • Maintain the confidentiality and security of your login credentials.
  • Accept full responsibility for all activities conducted through your account, whether authorized by you or not.
  • Use your account solely for lawful purposes and in accordance with these Terms.

You must immediately notify Examinity of any unauthorized access to or use of your account, or any other suspected security breach.

Examinity shall not be liable for any loss or damage arising from your failure to protect your account credentials.

We reserve the right to suspend, restrict, or terminate your account, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or unlawful activities, or otherwise misused the Platform.

Platform features may be modified, discontinued, or expanded without prior notice.

Products, Services & Purchases

Examinity provides a comprehensive learning and examination preparation ecosystem through a variety of educational products and services, which may include, but are not limited to:

  • Online learning resources
  • Mock tests and practice assessments
  • ExamReady real exam simulations
  • StudyPro publications and learning resources
  • MockPro test series
  • Digital books (eBooks) and printed publications
  • Subject guides, notes, and study materials
  • Previous Year Question (PYQ) resources
  • Current affairs and exam updates
  • Courses, workshops, and training programs
  • Examinity Pass subscriptions
  • Interview preparation and career guidance
  • Mentorship and academic support programs
  • Research publications and educational content
  • Mobile applications and software solutions
  • Premium educational resources and digital downloads
  • Any existing or future educational products, services, technologies, or features offered by Examinity

Examinity reserves the right to introduce, modify, suspend, discontinue, replace, or enhance any feature, product, service, or functionality of the Platform at any time, with or without prior notice, subject to applicable law.

Pricing

Prices for products and services may be updated, revised, or changed at any time without prior notice, except where otherwise required by applicable law.

Discounts, promotional offers, coupons, scholarships, bundle pricing, and limited-time campaigns may be introduced, modified, extended, or withdrawn at our sole discretion.

While we strive to ensure pricing accuracy, typographical, technical, or administrative errors may occasionally occur. We reserve the right to correct any pricing errors, update inaccurate information, cancel affected orders (subject to applicable law), and, where appropriate, offer you the option to proceed with the corrected price.

Payment

Payments for products and services available on the Platform are processed through authorized third-party payment service providers.

By making a purchase, you agree to provide accurate, complete, and valid payment information.

Examinity does not collect or store sensitive payment information such as debit/credit card numbers, CVV, UPI PINs, or banking passwords. Such information is processed directly by the applicable payment service provider in accordance with their respective terms and privacy policies.

We are not responsible for payment failures, delays, declined transactions, technical issues, or other errors arising from banks, payment gateways, financial institutions, or third-party payment service providers.

Orders may be declined, suspended, or cancelled if payment authorization cannot be verified, the transaction is unsuccessful, fraudulent activity is suspected, or required payment is not received.

Digital Products

Examinity may offer digital products and services, including but not limited to:

  • eBooks
  • Mock Tests
  • Online Courses
  • Study Notes

  • Videos
  • Learning Resources
  • Premium Content
  • Digital Publications
  • Downloadable Study Materials
  • Practice Resources

Upon successful purchase or authorized access, Users are granted a limited, revocable, non-exclusive, non-transferable, and non-sub licensable license to access and use the applicable digital products solely for their personal, non-commercial educational purposes, subject to these Terms.

The purchase or access of any digital product does not transfer ownership or any intellectual property rights to the User. All rights, title, and interest in the digital products remain the exclusive property of Examinity Learning Private Limited or its licensors.

Unless expressly permitted in writing by Examinity, Users shall not:

  • Copy, reproduce, modify, or create derivative works from any digital product.
  • Share, distribute, publish, upload, transmit, sell, rent, sublicense, or commercially exploit any digital product.
  • Remove or alter any copyright, trademark, or proprietary notices.
  • Circumvent or attempt to bypass any digital rights management (DRM), access controls, or security measures implemented by Examinity.

Any unauthorized use of digital products may result in suspension or termination of access and may lead to civil or criminal legal action where permitted by applicable law.

Subscriptions

Certain products and services offered through the Platform may be available on a subscription basis, including Examinity Pass and any future subscription plans introduced by Examinity.

Subscription details, including pricing, billing cycle, duration, renewal terms, included features, and applicable limitations, will be displayed at the time of purchase.

Unless otherwise stated:

  • Subscriptions are personal, non-exclusive, and non-transferable.
  • Subscription benefits are available only for the subscribed account and may not be shared, resold, or assigned to another person.
  • Examinity reserves the right to modify, suspend, or discontinue subscription plans, features, or pricing at any time, subject to applicable law. Such changes will not affect active subscriptions unless otherwise required by law or communicated to users.
  • Failure to pay applicable subscription fees may result in suspension or termination of access to subscription services.
  • Subscription purchases are subject to our Refund & Cancellation Policy, where applicable.

Intellectual Property

All content, materials, products, services, and technology available on the Platform are protected by applicable intellectual property, copyright, trademark, trade secret, and other proprietary laws.

Unless otherwise stated, all intellectual property rights in and to the Platform are owned by or licensed to Examinity Learning Private Limited.

This includes, but is not limited to:

  • StudyPro
  • MockPro
  • ExamReady
  • Examinity Pass
  • Examinity Mentor
  • InterviewPro
  • Examinity Academy
  • Logos, trademarks, brand names, domain names
  • Books, eBooks, publications
  • Question banks, mock tests, notes
  • Current affairs content, videos, images, graphics, illustrations, designs
  • User Interface (UI) / User Experience (UX)
  • Source code, software, mobile applications
  • Databases, APIs, Platform architecture
  • Research, learning, assessment, and educational methodologies
  • Documentation, training materials, user manuals, training guides
  • Digital assets and proprietary content
  • Future products, services, features, content, technologies, and intellectual property developed by Examinity

Except as expressly permitted in writing by Examinity, you may not:

  • Copy, reproduce, modify, adapt, translate
  • Publish, distribute, sell, license, rent, lease
  • Transfer, assign, display, perform, broadcast, record
  • Download (except where expressly permitted), store
  • Scrape, mine, reverse engineer, decompile, disassemble
  • Create derivative works or use for commercial purposes
  • Exploit any part of the Platform or its Content in any manner

Nothing contained in these Terms grants any ownership rights, title, or interest in any intellectual property belonging to Examinity. Users are granted only a limited, revocable, non-exclusive, non-transferable license to access and use the Platform solely for their personal, non-commercial educational purposes, subject to these Terms.

Any unauthorized use of the Platform or its intellectual property may result in suspension or termination of access and may give rise to civil, criminal, or other legal remedies available under applicable law.

Acceptable Use

By accessing or using the Platform, you agree that you will not:

  • Share, sell, rent, transfer, or allow others to use your account or login credentials.
  • Download, copy, reproduce, distribute, resell, or share any paid or premium content without prior written authorization.
  • Upload, transmit, or distribute viruses, malware, malicious software, or any harmful code.
  • Attempt to gain unauthorized access to the Platform, servers, databases, networks, user accounts, or any connected systems.
  • Interfere with, disrupt, damage, or compromise the security, integrity, or performance of the Platform.
  • Use bots, crawlers, scrapers, automated scripts, or similar technologies to access or extract content from the Platform without our prior written permission.
  • Circumvent, disable, or interfere with security features, access controls, digital rights management (DRM), or other protection mechanisms implemented by the Platform.
  • Reverse engineer, decompile, disassemble, modify, or attempt to derive the source code or underlying technology of the Platform.
  • Impersonate any individual, organization, or falsely represent your affiliation with any person or entity.
  • Post, upload, transmit, or distribute any content that is unlawful, fraudulent, abusive, defamatory, obscene, offensive, harmful, discriminatory, infringing, or otherwise violates applicable law or the rights of others.
  • Use the Platform for any unlawful, fraudulent, commercial, or unauthorized purpose.
  • Misuse, manipulate, or exploit any feature, functionality, assessment, recommendation, or learning tool available on the Platform.
  • Copy, record, reproduce, screenshot, photograph, livestream, or redistribute videos, mock tests, books, notes, question banks, digital content, or any other proprietary learning resources without prior written permission.
  • Attempt to bypass subscription restrictions, payment mechanisms, licensing controls, or access limitations.
  • Use the Platform in any manner that could damage the reputation, goodwill, intellectual property, or business interests of Examinity or its affiliates.
  • Engage in any activity that, in our reasonable opinion, adversely affects the Platform, other users, or our services.

Examinity reserves the right to investigate suspected violations of these Terms and may suspend or terminate user accounts, remove content, restrict access, or take any other appropriate action where it reasonably believes these Terms have been violated, subject to applicable law.

Compliance with Laws

Users agree to access and use the Platform in compliance with all applicable local, state, national, and international laws, regulations, rules, and governmental requirements.

Users are solely responsible for ensuring that their use of the Platform, Content, products, services, Platform features, communications, and any activities conducted through their account comply with all applicable laws and do not infringe the rights of any third party.

Examinity reserves the right to suspend, restrict, or terminate access to the Platform where it reasonably believes that a User's activities violate applicable laws, regulations, or these Terms.

User Content

If you submit, upload, post, or otherwise provide reviews, comments, feedback, suggestions, testimonials, ratings, images, videos, or any other content ("User Content") on or through the Platform:

  • You represent and warrant that you own or have the necessary rights and permissions to submit such User Content.
  • You remain solely responsible for the accuracy, legality, and content of your User Content.
  • You grant Examinity a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and otherwise use your User Content for the purpose of operating, improving, promoting, and marketing the Platform and its services.
  • You acknowledge that Examinity is under no obligation to publish, retain, or compensate you for any User Content.

You must not submit any User Content that:

  • Infringes the intellectual property or other rights of any third party.
  • Is unlawful, defamatory, abusive, obscene, fraudulent, misleading, or otherwise objectionable.
  • Contains malicious code, viruses, or other harmful software.
  • Violates any applicable law or regulation.

Examinity reserves the right, but is not obligated, to monitor, review, edit, refuse, or remove any User Content that, in its sole discretion, violates these Terms or is otherwise considered inappropriate, unlawful, or harmful.

Intellectual Property Complaints

Examinity respects the intellectual property rights of others and expects all users of the Platform to do the same.

If you believe that any content available on the Platform infringes your copyright, trademark, or other intellectual property rights, you may submit a written notice to us at: support@examinity.in

Your notice should include, where applicable:

  • Your full name and contact information.
  • A description of the intellectual property right that you claim has been infringed.
  • Evidence demonstrating your ownership of the intellectual property or authorization to act on behalf of the rights holder.
  • The URL, location, or other information reasonably sufficient to identify the allegedly infringing content.
  • A statement describing the nature of the alleged infringement.
  • A declaration that the information provided is true, accurate, and complete to the best of your knowledge, and that you are the owner of the intellectual property right or are authorized to act on behalf of the rights holder.

Upon receipt of a sufficiently detailed notice, Examinity may review the complaint and, where appropriate, remove, disable access to, or otherwise address the allegedly infringing content in accordance with applicable law.

Examinity reserves the right to request additional information or documentation before taking any action and shall not be obligated to remove or disable access to any content where it reasonably determines that the complaint is incomplete, unsupported, or otherwise without merit.

Educational Disclaimer

The Platform is intended solely to support learning, skill development, and exam preparation by providing educational resources, practice materials, assessments, publications, and related services.

Examinity does not represent or warrant that its educational content will be suitable for every examination, institution, recruitment process, or individual learning requirement.

While Examinity strives to provide high-quality educational content and learning tools, we do not guarantee or warrant:

  • Selection in any examination
  • Admission to any educational institution
  • Employment or job placement
  • Selection in any government or private recruitment process
  • Any specific rank, score, percentile, or performance improvement
  • Success in any examination, interview, or assessment

Every user's learning journey and examination outcome depend on numerous factors beyond our reasonable control, including individual effort, preparation strategy, consistency, prior knowledge, examination difficulty, competition, changing examination patterns, personal circumstances, and other external factors.

Accordingly, no content, product, service, recommendation, mock test, educational content, publication, or learning resource provided through the Platform shall be construed as a guarantee of any specific academic, professional, or examination outcome.

Availability

Examinity strives to maintain the continuous availability, security, and performance of the Platform. However, we do not guarantee that the Platform or any part of the Services will be available at all times or operate without interruption, delay, error, or downtime.

The availability of the Platform may be affected by factors including, but not limited to:

  • Scheduled maintenance or system upgrades
  • Technical failures or software errors
  • Internet or network interruptions
  • Power outages
  • Third-party service or infrastructure failures
  • Cybersecurity incidents or unauthorized attacks
  • Government actions or regulatory requirements
  • Natural disasters, pandemics, or other force majeure events
  • Any other circumstances beyond our reasonable control

We reserve the right to suspend, restrict, modify, or discontinue any part of the Platform or Services at any time for maintenance, security, operational, legal, or business reasons, with or without prior notice, where permitted by applicable law.

Third-Party Services

The Platform may integrate with, provide access to, or contain links to third-party websites, applications, payment gateways, social media platforms, analytics providers, communication services, and other external services ("Third-Party Services").

These Third-Party Services are operated independently and are governed by their own terms, conditions, and privacy policies. Examinity does not own, control, endorse, or assume responsibility for the content, accuracy, availability, security, products, services, or practices of any Third-Party Services.

Your interactions with Third-Party Services are solely between you and the respective third party. We encourage you to review their applicable terms and privacy policies before using such services.

Examinity shall not be liable for any loss, damage, or claim arising from your access to or use of any Third-Party Services, except to the extent required by applicable law.

Suspension and Termination

Examinity reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to the Platform, in whole or in part, with or without prior notice, if we reasonably believe that you have:

  • Violated these Terms & Conditions or any applicable policies;
  • Misused or abused the Platform or any of its services;
  • Engaged in fraudulent, unlawful, deceptive, or unauthorized activities;
  • Infringed or misappropriated the intellectual property rights of Examinity or any third party;
  • Compromised the security, integrity, or proper functioning of the Platform;
  • Harassed, threatened, or caused harm to other users, employees, partners, or the Platform; or
  • Engaged in any conduct that we reasonably determine may adversely affect Examinity, its users, or its business operations.

Upon suspension or termination:

  • Your right to access and use the Platform shall immediately cease.
  • Any licenses or permissions granted under these Terms shall automatically terminate.
  • Examinity may remove or restrict access to your account and purchased content where permitted by applicable law and these Terms.
  • Any outstanding payment obligations incurred before termination shall remain payable.
  • Termination shall not affect any rights, remedies, obligations, or liabilities that accrued prior to the date of termination.

Examinity reserves the right to take any additional legal or equitable action available under applicable law to protect its rights, users, and intellectual property.

Refunds, Cancellations & Replacements

Refunds, cancellations, replacements, and exchanges (where applicable) are governed by Examinity's Refund & Cancellation Policy, which is incorporated into and forms an integral part of these Terms. Different refund or replacement conditions may apply to digital products, physical products, subscriptions, courses, and other services. By purchasing any product or service through the Platform, you agree to the applicable Refund & Cancellation Policy.

Limitation of Liability

To the fullest extent permitted by applicable law, Examinity Learning Private Limited, its affiliates, directors, officers, employees, licensors, partners, contractors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or other similar damages, including but not limited to loss of profits, revenue, data, business opportunities, goodwill, anticipated savings, or any other intangible losses arising out of or in connection with:

  • your access to or use of, or inability to access or use, the Platform;
  • any interruption, suspension, delay, or unavailability of the Platform;
  • any unauthorized access to or alteration of your data or account;
  • reliance on any information, educational content, recommendations, or materials available through the Platform; or
  • any third-party products, services, websites, or content.

To the maximum extent permitted by applicable law, the aggregate liability of Examinity arising out of or relating to these Terms or the Platform shall not exceed the total amount actually paid by you to Examinity for the specific product or service giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to such claim.

Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law.

No Warranty

Except as expressly provided under applicable law, the Platform, Content, products, services, software, Platform functionalities, publications, and all related materials are provided on an "AS IS" and "AS AVAILABLE" basis.

Examinity expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, or uninterrupted operation.

We do not warrant that:

  • the Platform will always be available;
  • the Platform will be error-free or secure;
  • defects will always be corrected;
  • the Platform will meet every user's expectations or requirements; or
  • the Platform will always be free from viruses or other harmful components.

Indemnification

You agree to indemnify, defend, and hold harmless Examinity Learning Private Limited, its affiliates, subsidiaries, directors, officers, employees, agents, licensors, partners, service providers, and representatives from and against any claims, demands, actions, liabilities, damages, losses, costs, expenses, judgments, penalties, or reasonable legal fees arising out of or relating to:

  • Your breach of these Terms or any applicable policies.
  • Your misuse of the Platform or any of its products or services.
  • Your violation of any applicable law, regulation, or third-party rights.
  • Your infringement or alleged infringement of any intellectual property or other proprietary rights.
  • Any content, information, or material submitted, uploaded, shared, or transmitted by you through the Platform.
  • Any negligent, fraudulent, or unlawful act or omission by you.

This obligation shall survive the suspension or termination of your account and your use of the Platform.

Force Majeure

Examinity shall not be liable for any delay, interruption, or failure to perform its obligations under these Terms to the extent such delay, interruption, or failure results from events beyond its reasonable control. Such events may include, but are not limited to, natural disasters, floods, earthquakes, fires, pandemics, epidemics, acts of government, changes in law or regulations, war, terrorism, civil unrest, strikes or labor disputes, power outages, internet or telecommunications failures, cyberattacks, system failures, failures of third-party service providers, or any other force majeure event.

Where reasonably practicable, Examinity will make commercially reasonable efforts to restore affected services as soon as possible.

Changes to the Platform

Examinity reserves the right to modify, update, suspend, discontinue, replace, enhance, or remove any part of the Platform, including its products, services, features, functionality, content, pricing, subscriptions, or availability, at any time and without prior notice, to the extent permitted by applicable law.

Such changes may be made for operational, technical, security, legal, regulatory, commercial, or business reasons. Examinity shall not be liable for any modification, suspension, or discontinuation of the Platform or any part thereof, except where liability cannot be excluded under applicable law.

Electronic Communications

By using the Platform, you consent to receive communications from Examinity electronically, including by email, SMS, WhatsApp, push notifications, or through the Platform, where permitted by applicable law.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Examinity regarding your use of the Platform and supersede all prior communications or agreements relating to the subject matter.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to applicable law, the courts having jurisdiction over the registered office of Examinity Learning Private Limited shall have exclusive jurisdiction over disputes arising out of or relating to these Terms.

Changes to These Terms

We may update, modify, or revise these Terms from time to time to reflect changes in our services, business practices, legal requirements, or for other operational reasons.

The updated version will be published on the Platform with a revised "Last Updated" date. Where required by applicable law or where the changes are material, we may also notify users through email, in-app notifications, or other appropriate communication channels.

Your continued access to or use of the Platform after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue using the Platform.

Acknowledgement. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to these Terms.
